§ 6.1.250. Unattended animal in a motor vehicle.

  • A.

    It is unlawful for any person to leave an animal unattended in a standing or parked motor vehicle in a manner that endangers the health or safety of the animal.

    B.

    A person may use reasonable force to remove from a motor vehicle an animal left in the vehicle in violation of subsection (A) if the person is:

    1.

    an Animal Control Officer;

    2.

    a law enforcement officer; or

    3.

    a professionally licensed fire rescue service person.

    C.

    Persons identified in subsection (B) must be within their jurisdiction or otherwise acting within the scope of their lawful authority.
